1. Website
These terms and conditions govern your use of the Cuban Guru website; by using our website, you accept the terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use the Cuban Guru website. You must be at least [18] years of age to use the Cuban Guru website. By using our website [and by agreeing to our terms and conditions] you warrant and represent that you are at least [18] years of age. The Cuban Guru website uses cookies. By using our website and agreeing to our terms and conditions, you consent to The Cuban Guru’s use of cookies in accordance with the terms of The Cuban Guru’s [privacy policy / cookies policy].
2. Acceptable use of our Website
You must not use The Cuban Guru’s website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. You must not use our website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software. You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our website without CUBAN GURU LLC’S express written consent. You must not use The Cuban Guru’s website to transmit or send unsolicited commercial communications. You must not use this website for any purposes related to marketing without CUBAN GURU LLC’S express written consent.
3. Online Booking and Registration
Process After contacting one of our representatives, a sample itinerary (preset or custom) will be provided for your review. Once you agree to use CUBAN GURU LLC as your guide in the People to People Educational Program in Cuba, you will be required to register through our system. If you choose to use our website to book an educational program, rent a car or reserve your own accommodations, you will be required to create an account and register before you are allowed to proceed. Whether booking online or through us directly, in order to complete a booking on your behalf, we must disclose your personal data to third parties (including intermediaries); this includes (but is not limited to) applying for visas, purchasing flight tickets, making hotel reservations, coordinating with Cuban tour operators etc.
4. Deposit Requirements
A $1000 non-refundable deposit is due at the time of registration.
5. Payments
The customer agrees to pay CUBAN GURU LLC for services rendered. These fees are associated with the educational programs that will be organized for each customer or their group. These services allow customers to engage in legal people to people activities in Cuba and all arrangements made by our professional team in the US as well as our partners in Cuba. Consideration paid for our educational programs include all accommodations, meals, entries to all places requiring admission, excursions, English speaking tour guides, all land transportation while in Cuba and any other activities set forth in the customer’s itinerary & invoice. Please note, all services in Cuba are Prepaid, no reservations will be guaranteed until payments are made in full. A $1000 non-refundable deposit is required at time of registration. Full payment is due 90 days prior to arrival date (deposit will be applied). All prices are subject to change unless payment has been received in full & confirmation has been provided.
6. Refunds and Cancellations
CUBAN GURU LLC may reject, cancel or reschedule a program for any customer at any time prior the departure date without prior notice. In the unlikely event that such a cancellation occurs, this includes rejecting a customer, the total amount that was collected by CUBAN GURU LLC will be refunded, unless the cancellation is due to non-payment by customer. CUBAN GURU LLC will not be responsible to the customer for anything other than the refund, this includes any additional fees incurred, costs, interest, liability or damages of any kind. In order to obtain a refund, you must notify us in writing, by mail or email, 61+ days prior to arrival date (see our contact information). The amount of refund will be reduced by any expenses Cuban Guru LLC has incurred organizing your trip. If cancellation is made less than 60 days prior to arrival date, all monies paid will be forfeited. No exceptions will be made to CUBAN GURU LLC’s cancellation policy for any reason, including any medical emergencies. No refunds will be available for portions of the programs that are not used for any reason.
7. Age Requirements
All persons booking through CUBAN GURU LLC must be no less than 18 years of age. If a minor (18 years or younger) is traveling without both parents, CUBAN GURU LLC will provide an affidavit form that must be filled out and notarized… NO EXCEPTIONS.
8. Legal Requirements
CUBAN GURU LLC may supply personal data to a government authority or regulator, police authority, court or party in litigation, where requested to cooperate with the authority or required to comply with a legal requirement, for the administration of justice, for purposes of customs, visas and immigration, or where reasonably required to protect your interests or enforce any booking or other contract. We may disclose your personal data where otherwise required by or permitted by law. 9. Changes to our Programs Although every attempt is made to provide you with the exact program outlined in our itineraries when you reserve, due to circumstances out of our control, there may be times when some components may require adjustments or exclusions. CUBAN GURU LLC reserves the right to make these adjustments; if a customer cancels their trip as a direct result from this action, CUBAN GURU LLC may apply normal cancellation penalties.
10. Flight Arrangements to Havana
Our educational programs DO NOT include airfare. Flights to and from Cuba are the sole responsibility of each person.
11. Cuban Visa & Passports
We offer FREE Visas to all our Travelers with a fully paid reservation. The customer’s passport must be valid from the time they leave the US upon returning from our programs in Cuba, and 6 months after. A customer that holds a passport from a foreign country, special passport, U.S. Visa or Green card, is responsible for the understanding of any limitations imposed on these. CUBAN GURU LLC will not be liable for a customer who is not accepted and/or refused service or their entry to Cuba. If the customer is refused, applicable cancellation penalties will apply. Customer is responsible for carrying proper documentation to enter Cuba and subsequently return to the U.S.; when applicable, it is the customer’s responsibility to have proper documentation when traveling via a third country to Cuba. All US citizens (or any foreigner leaving from the US) are required to have a Cuban Visa to enter Cuba.
12. Cuban Born Travelers
The Cuban Government imposes different requirements for all Cuban born persons. For such persons, obtaining a Visa can take anywhere from 4-12 weeks. CUBAN GURU LLC strongly suggests that all customers that fall under this category contact the appropriate entities for clarification on this issue.
13. Passengers with Special Needs
Any customer with a disability that may require special attention must inform CUBAN GURU LLC at the time the initial contact is made. CUBAN GURU LLC will make all reasonable attempts in order to accommodate any special needs the customer may have. The customer understands that CUBAN GURU LLC may not be able to guarantee some accommodations and will not be liable for any denial of services by any Cuban entities, carriers or hotels. CUBAN GURU LLC cannot provide individual assistance for dining, walking, etc.; nor are we responsible for providing anything that is not included in the program. Any customer with special needs must be accompanied by a qualified companion.
